Terms and conditions
1. These terms and conditions govern the Barclays Business Prize Draw (the “Prize Draw”) and by entering the Prize Draw you will be taken to have agreed to these terms and conditions.
2. In these terms and conditions, ‘we’, ‘us’, or ‘our’ refer to Barclays Bank PLC, and ‘you’ and ‘your’ refer to a customer who enters the Prize Draw, and this can include bodies corporate such as companies or limited liability partnerships.
3. The opening date of the Prize Draw is 27 February 2012, and the last date on which you can enter is 30 June 2012.
4. To enter the Prize Draw and be eligible to win the prize you must open a start-up business current account with Barclays Business or move your business current account to Barclays Business on or after 27 February 2012, and before close of business on 30 June 2012, and the account must still be open and active on 31 October 2012. We explain what we mean by ‘active’ in condition 5. Individuals (that is, sole traders and partners in partnerships) must be aged 18 or over and be a resident of England, Scotland or Wales, and any customers which are business organisations (that is, partnerships or bodies corporate) should have their main or (where appropriate) registered address in England, Scotland or Wales. Employees of Barclays Bank PLC or anyone materially connected to the administration of the Prize Draw are not eligible for, and will not be entered into the Prize Draw.
5. Your account will be ‘active’ for the purposes of the Prize Draw if either of the following criteria are met:
- the total turnover on the account by close of business on 31 October 2012 is equal to or greater than £2,500; or
- we are reasonably satisfied that the business is actively trading. We may ask you for information about your business if this is reasonably required to reach a decision.
6. The customer named as the accountholder will be the entrant into the Prize Draw and will be entitled to the prize if they win. For the avoidance of doubt, this means that if the winner is a body corporate, the prize will belong solely to that body corporate, and not directly to its directors, members or shareholders (as appropriate).
7. You will only be entered into the Prize Draw once, irrespective of how many accounts you open (so, for example, if you open more than one current account you will only be entered into the Prize Draw once).
8. If you open a start-up business current account or move your business current account to Barclays Business between 27 February 2012 and 30 June 2012 and you do not want to be entered into the Prize Draw, then you can opt out by emailing barclaysbusinessoptout@barclays.com no later than 14th July 2012.
9. If you do not want to receive the prize, then you can either ask us to give it to a registered charity of your choice; or you can decline the prize, in which case we will draw another winner and give the prize to them.
10. The prize will be a cash prize of £50,000. No alternatives to the prize offered will be given.
11. We will pay you the prize by cheque, unless we agree otherwise with you. You can decide how you will use the prize money.
12. We will do the draw on 3 December 2012, and the draw will be supervised by an independent observer.
13. If you are the winner, and we know your telephone number, we will try to contact you on that number to tell you that you have won, and in any event we will notify you in writing by 10 December 2012. Subject to condition 14, we will send you the prize by post or courier (unless we agree with you that you will be given the prize another way) no later than 31 January 2013.
14. If you win, but you have not responded to us about the prize within one month of us writing to you, then we will draw another winner and give the prize to them.
15. Where the winner is an individual, we may give the prize to the winner’s personal representatives for the benefit of the winner’s estate if, before we send the prize, we learn that the winner is deceased. This is not applicable to bodies corporate.
16. The name and county of the winner and the name of the independent observer will be available to anyone sending a stamped addressed envelope to Nigel Stott, Barclays, Longwood Close, Westwood Business Park, Coventry, West Midlands, CV4 8JG no later than 31st January 2013, and you agree that, if you win, we may supply your name and county under this condition, or publish your name and county in any media.
17. If you win, we may invite you to take part in a presentation of the prize or other publicity, which may include a photograph of you. You do not have to agree to this.
18. The promoter of the prize draw is Barclays Bank PLC. Our registered address is 1 Churchill Place, London, E14 5HP.
19. You are responsible for any tax liability which arises as a result of being given the prize, and, if necessary, you should consider whether you need to get independent tax advice before accepting the prize.
