Changes to Barclays Pingit terms & conditions

We have revised the Barclays Pingit terms as follows: 

  • To indicate that you may give us feedback or ideas about Barclays Pingit and how we treat any feedback or ideas we receive from you
  • To clarify that different payment limits apply to business customers using the service (details of these are available on our website)

Please ensure you read and accept these terms & conditions to use Barclays Pingit. You can download a copy of the latest version from Barclays.co.uk/pingit .
 

Part A – Summary of terms & conditions

Barclays Pingit allows you to make or receive sterling payments of £1 or more using your phone. It is only available to persons aged 16 years and above and businesses operating in the UK. You can also use Barclays Pingit to make international payments to Barclays customers in selected countries (qualifying countries). You must have a UK current account to use Barclays Pingit and you can register to make or receive payments or both.

To make payments you must have a Barclays account or a Barclays Pingit Wallet account and register for the Barclays Pingit service to be linked to that account. If you have a joint account, each account holder can register separately for the service.

Once registered, you can make payments by giving us the recipient's mobile number (before doing this, please check they are happy for their number to be shared in this way and ensure the number you use is current and correct because we will not be responsible if you send money to the wrong payee). Payments in sterling to UK customers will be sent once they register for Barclays Pingit and tell us which account to make the payment to. If they do not register within 24 hours of a payment being requested it will be cancelled. We will tell you if this happens.

International payments can only be made to customers in qualifying countries who have pre-registered for an appropriate Barclays service. A list of the qualifying countries is available in the app and on our website.

For certain businesses, you can also make payments using a reference or scanning a code they give you. There is a maximum daily limit of £750 for payments that you can make through the service using a mobile number but different limits may apply if you are a business or when you pay a business using a reference or code or you ask us to make an international payment.

To receive payments you must: (a) have a UK mobile number and a UK bank account that can receive payments through Faster Payments; or (b) set up a Barclays Pingit Wallet account. If you have a Barclays account but do not have a smartphone or you just want to receive payments, you can register online to do so. For personal customers, there is a maximum daily limit of £5,000 for all payments received through the service. Details of the limits that apply to business customers and international payments are available on request or from Barclays.co.uk/pingit .

When you register, we can place restrictions or limits on how you use your Barclays Pingit Wallet account. We will tell you of these restrictions and limits and the steps you need to take to get full use of the account.

You can only send an invite to someone or request a payment from them if you have their permission, but you must not send unsolicited messages, repeat or mass requests or use the app in an inappropriate way. You should not use the app to request or collect any payments that are not owed to you or that are overdue. Barclays takes no responsibility for any messages or requests you sent or their contents.

Barclays Pingit app only works with compatible devices running Android 2.2 and above iOS 4.2 and above or BlackBerry OS 5.0 and above. You may need to upgrade the operating system on your device if we change the version(s) we support. You may not be able to install or use the app on a jail-broken or rooted device.

You may be charged by your service provider for internet access on your Smartphone.

Visit Barclays.co.uk/pingit for more information (including limits that apply when using the service) and full terms & conditions. These can also be accessed through the App. We can refuse to register you for Barclays Pingit and we can also ask you to complete registration at a Barclays branch.

 

Part B – app terms

These additional conditions relate to the use of the Barclays Pingit app (the service) and supplement and amend the general terms which apply to the Barclays account or Barclays Pingit Wallet you link to the Service (general terms).


1. Use of cookies

By using the Barclays Pingit app, you consent to us accessing information about your device for the purpose of registration and authentication when using the app. The Barclays Pingit app also uses session cookies which are needed for the app to work effectively. Further details in relation to cookies and mobile apps can be found at www.barclays.co.uk


2. Use of location data

2.1 2.1 Certain services, including the ATM finder, will make use of location data sent from your mobile device. You can turn off this functionality at any time by turning off the location services settings for the Barclays Pingit App on your Mobile Device. If you use these services, you consent to us and our partners' and licensees' transmission, collection, maintenance, processing and use of your location data and queries to provide and improve location-based and road traffic-based products and services. You may withdraw this consent at any time by turning off the location services settings on your mobile device (for Android) or on the Barclays Pingit App (for other mobile devices).

2.2 2.2 Access to Google Maps/Google Earth APIs through the Barclays Pingit App (iOS and Android versions) is subject to the separate Google Maps/Google Earth APIs Terms & Conditions available at http://www.google.com/accounts/TOS


3. Contacting you

3.1 We will contact you from time to time about the service, including marketing messages relating to the service. We will do this electronically – for example by email, text or other messages on the Barclays Pingit App or by telephone or post.

3.2 We and other companies in the Barclays Group may contact you with information about our products and services (and those of specially selected parties) that may be of interest to you, in line with your marketing contact preferences provided to us either through the Barclays Pingit App or elsewhere. All such communications will come from Barclays. We will never pass your data to any third parties for their own use.

3.3 You may tell us at any time if you do not wish to receive marketing messages from us by contacting us as set out in your general terms or by following any instructions we may include in the message we send to you. For example, a STOP message will appear at the foot of marketing text messages we send you.
 

4. Sharing your information

4.1 Barclays Pingit enables you to send or receive money and pay individuals, businesses or charities. You authorise us to disclose your full name and mobile number when you use the app or when we process your request or display this information in messages sent to your payees or recipients. This information is drawn from records that we already hold about your account and may be different to any names, nicknames or other pseudonyms you are known by or use when registering for Barclays Pingit.


5. Use of the app

5.1 The Barclays Pingit app is a form of online banking. This means that provisions of the general terms relating to online banking apply to operation of Barclays Pingit. We may block or suspend your use of the app if you breach these provisions or our terms & conditions.

5.2 In addition, you must:

(a) Ensure you comply with any local restrictions on downloading, using or otherwise exporting the Barclays Pingit app (including any encryption keys or similar content stored in it)

(b) Only install the Barclays Pingit app from a site or store approved by Barclays

(c) Not use Barclays Pingit in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the agreement, or act fraudulently or maliciously for example, by hacking into or inserting malicious code into the Barclays Pingit app or iPhone, Android or BlackBerry operating systems

(d) Not use Barclays Pingit to send unsolicited messages, repeat or mass requests or to bully, harass or interfere with the rights of others

(e) Not use the Barclays Pingit app to request or collect any payments that are not owed to you or that are overdue

(f) Not attempt to derive income from the use or provision of the service or any information (including personal information) you obtain through the service, whether for direct commercial or monetary gain or otherwise

(g) Not use Barclays Pingit in a way that could damage disable, overburden, impair or compromise the service, Barclays systems or security or interfere with other users

(h) Not collect, collate or harvest any information or data from the service or our systems or attempt to decipher any transmissions to or from the servers running Barclays Pingit or attempt to use such information or data to create, amend or update your records or for any commercial or non-personal use such as marketing or promotional activities or sharing it with someone else.


5.3 The Barclays Pingit app may utilise or include third-party software and copyrighted material or may be subject to an open-source license or other licence. Portions of the software are based in part on:

5.4 If you provide feedback or ideas (suggestions) about Barclays Pingit, you understand we may use your suggestions without any obligation to attribute them to you or to compensate you. You must not give us any information that is confidential, commercially sensitive or contains original creative work or is the intellectual property or proprietary property of you or another person. Any suggestions you make will automatically become the property of Barclays.


6. Security

6.1 Because the Barclays Pingit app can be used to make payments from your account, you must keep your mobile device secure and not logged into the app. The conditions relating to payment instruments set out in the general terms apply in relation to the Barclays Pingit app.

6.2 If you suspect that someone else knows your passcode or other security details, you must contact us immediately by calling us on 03332 001 012 or the number available on our website. If you fail to do so, you may be liable for any unauthorised transactions on your account that are as a result of your security details becoming known to someone else.

6.3 After your initial registration we will never contact you to request your security details and we will not ask anyone else to do so on our behalf. If you receive such a request then it is likely to be fraudulent and you must not supply your security details in any circumstances. You should report any such activity to us immediately.

6.4 You must ensure that your account number, sort code, mobile number and other details provided are correct and up to date and notify us as soon as these change.


7. Liability

7.1 We will not be liable to you for any losses you suffer or costs you incur because:

(a) You are unable to access or use Barclays Pingit for any reason or there is a delay in its use;

(b) Any device, hardware or software you use in connection with the App is damaged or corrupted or fails to work;

(c) The app does not work as you expect, does not meet your requirements or contains errors or defects or we fail to correct these;

(d) You did not receive any SMS notifications in a timely manner

(e) There is a reduced level or failure to provide any service caused by any third-party service providers including software providers and mobile operators.


8. Helpdesk

For assistance in your use of Barclays Pingit, please call 03332 001 012. This service will be available from 7am to 11pm every day excluding public holidays.


9. Changes to Barclays Pingit terms & conditions

9.1 We can change the terms & conditions at any time in accordance with the general terms by sending you an SMS with details of the change or notifying you of a change when you next start the app or visit our website. The new terms will be displayed on-screen and you may be required to read and accept them to continue your use of Barclays Pingit.

9.2 From time to time updates to the app may be issued via the Apple App Store, Google Play Store, BlackBerry App World or other application store or download location from which the app is available. Depending on the update you may not be able to use the app until you have downloaded the latest version and accepted any new terms.


Part C – Send terms

These additional conditions relate to the use of the Barclays Pingit service and supplement and amend the general terms which apply to the Barclays account or Barclays Pingit Wallet you link to the service ("General Terms").


1. Registering your account

1.1 Before you can make payments you must register and match your mobile number with a qualifying Barclays account or a Barclays Pingit Wallet account.

1.2 Any payments you receive from other Barclays Pingit users will be paid into your linked Barclays account or Barclays Pingit Wallet.


2. Making payments

Sterling payments

2.1 Once registered to make and receive payments, you can make a payment to anyone with a UK bank account (the payee) by providing their UK mobile number. The payment can be made only once the payee has registered for the service and provided us with their account details. We will send them a text message asking them to register. By using the service to make a payment you are asking us to make the payment once we receive those details. If we have not received those details within 24 hours of sending the payee a text message, the payment will be cancelled.

International payments

2.2  You can also use Barclays Pingit to send money to Barclays customers registered to receive Barclays Pingit international payments in specified qualifying countries. A list of qualifying countries is available in the app and on our website. You must check with the payee that they are registered to receive international payments before attempting to send them a payment. If they are not, we will tell you when you attempt to make the payment.

Other conditions for making payments

2.3 You must get the payee’s consent before giving us their number.

2.4 Each payment must be for at least £1 and you can make payments of up to a maximum of £750 in any one day. Different limits may apply if you register as a business customer.

2.5 We can refuse to process a payment for the reasons set out in the general terms or if we reasonably believe that you have not met any of these additional conditions.

2.6 A payee can receive a maximum of £5,000 in any 1 day unless they are a business customer or registered to receive international payments only in which case a different limit may apply.  We will refuse to process a payment if it would exceed that limit.

2.7 You can send a request for a payment or include a personal message for the payee when making a payment but the request or message must not contain personal details and must be appropriate and not offensive. Barclays takes no responsibility for the message or request or its contents.

2.8 By selecting a contact when using the app to make a payment or send a message, you consent to the Barclays Pingit App accessing data in your address book.


3. Gift Aid payments

If you ask us to make a payment to a charity, we may ask you if you want to add Gift Aid to your donation through accepting a Gift Aid declaration. If you accept this declaration, you are giving your consent for us to send to the charity certain personal information we hold about you, including your mobile number, name and address. We will share this information with the charity on the basis that they will only use it to collect the Gift Aid payment or contact you to administer the payment.


4. Mistaken payments

When making a payment, you must ensure the payee information (including their mobile number or, where you use a reference or code to generate the payment information, the payee, payment reference and amount) is current and correct, otherwise the payment may be returned or made to the wrong payee. We will not be liable to you if the payment is sent to the wrong person as a result but will try to recover the payment in accordance with the general terms.


5. Charges

We do not charge you for sending sterling payments in the UK through Barclays Pingit (network charges may apply for using the app). International payments will be subject to charges and exchange rates as set out in the general terms.  If you are a business customer, you may incur standard charges for making payments as set out in your tariff.


Part D – Receive terms


1. Registering your account

1.1 Before you can receive payments you must register and match your mobile number with either: (i) a UK current account to which payments can be made through the Faster Payments network; (ii) your Barclays current account; or (iii) a Barclays Pingit Wallet account. If you are registering with your Barclays account only to receive payments, these additional conditions supplement and amend the general terms that apply to the Barclays account or Wallet you link to the service (general terms).

1.2 You must register for the service within 24 hours of receiving a text message from us that a payment is pending. If you do not, we will cancel the payment and you must contact the payer to arrange an alternative means of payment.


2. Authority to debit account

2.1 By registering for the service, you confirm that you are the intended recipient of the money that our customer is paying to you. If, using this service, you receive any payments by mistake, you must tell us as soon as possible and return the payment to us.

2.2 You hereby authorise the bank holding your account to debit that account and return the amount of the payment to us. If the bank is unable to do this, you agree that we can disclose your details to the payer so that they can take action to recover the mistaken payment.


3. Receiving payments

3.1 Once you have registered, we will send the payment to your nominated account. In doing this we are acting as payment service provider for the payer and are not providing any service directly to you, unless that account is held with us.

3.2 You can receive a maximum of £5,000 in any 1 day unless you are a business customer, in which case a different limit may apply to you. We will refuse to process a payment if it would exceed that limit.

3.3 You authorise us to display the full name of the account and your mobile number to the payer when they input your mobile number into the app. This information is drawn from records that we already hold about your account and may be different to any names, nicknames or other pseudonyms you are known by or use when registering for Barclays Pingit.

3.4 Your registration for the service does not create any obligations on us in relation to the receipt of payments by you (unless your account is held with us). Our obligations are to Barclays Pingit users sending you money. In particular, we may make changes to these receive terms and how other Barclays Pingit users can make payments to you, and can end your ability to receive payments through the service, at any time without first notifying you of those changes.

3.5 You must not generate, distribute, or offer to any payee, any code or reference for use with the app unless you have our prior written permission to do so.


4. Charges

We do not charge you for receiving payments through Barclays Pingit (network charges may apply for using the app).


5. Information about you

5.1 If you are using your Barclays current account to receive payments, we will use your information as set out in the general terms

5.2 If you are registering an account you hold with another bank, we will use any information you provide to us in connection with receiving payments only for the purposes of administering those payments and to contact you about Barclays Pingit including sending you text message about the promotions relating to the service.

5.3 You may tell us at any time if you do not wish to receive marketing messages from us by contacting us as set out in your general terms (if you are a Barclays current account customer) or by following any instructions we may include in the messages we send to you. For example, a STOP message will appear at the foot of marketing text messages we send you.

5.4 If false or inaccurate information is provided or fraud is suspected, details may be passed to fraud prevention and credit reference agencies. Law enforcement agencies may access and use this information. The information recorded by fraud prevention agencies may be accessed and used by organisations in the UK and in other countries. Please contact us if you want to receive details of the relevant fraud prevention agencies.

5.5 We and other companies in the Barclays Group will use your information for assessment and analysis (including behaviour scoring, market and product analysis and market research), to develop and improve our services to you and other customers and protect our interests. We and other companies in the Barclays Group may also use your information for market and product analysis in order to generate statistical reports which may be shared with external non-Barclays companies for their own use. These reports are aggregated and will not contain any information that identifies you.

5.6 We may give information about you and how you use Barclays Pingit to the following

(a) Other companies within the Barclays Group and our relationship partners

(b) Companies and organisations who provide a service to us or are acting as our agents (including their sub-contractors), on the understanding that they will keep the information confidential

(c) Companies and organisations that assist us in processing transactions made via Barclays Pingit (including but not limited to payment processing service providers)

(d) Anyone to whom we transfer or may transfer our rights and duties under this agreement

(e) Any third party as a result of any restructure, sale or acquisition of any company within the Barclays Group, provided that any recipient uses your information for the same purposes as it was originally supplied to us and/or used by us

Otherwise we will keep information about you confidential unless we have a duty to disclose it or law or regulation allows us to do so for legitimate business purposes.

5.7 If we transfer your information in accordance with condition 5.5(a), 5.5(b) or 5.5(d) to a person, office, branch or organisation located in another country, we will make sure that they agree to apply the same levels of protection as we are required to apply to your information and, where appropriate, to use your information strictly in accordance with our instructions.

5.8 We will retain information about you after your registration for Barclays Pingit is cancelled, or if your application is declined or abandoned, for as long as permitted for legal, regulatory, fraud and other financial crime prevention and legitimate business purposes (such as contacting you about Barclays Pingit).

5.9 You can ask for a copy of the information we hold about you by writing to us. A fee will be charged for this service.


6. Barclays Pingit Acceptance Mark

If you are a business customer you may download a Barclays Pingit acceptance mark (the 'trade mark') from our website Barclays.co.uk/pingit and use it to indicate that you accept Barclays Pingit payments from your customers. You acknowledge that the Barclays Pingit acceptance mark is a trade mark of Barclays and by downloading or using it you agree to comply with all guidelines and conditions we publish on using the trade mark and not to interfere with or challenge our rights to the trade mark or do anything that may bring Barclays or the trade mark any harm or disrepute. All use that you make of the trade mark will be for the benefit of Barclays and you acknowledge that we may at our sole option withdraw the trade mark from use at any time.


Part E – Wallet terms

The general conditions of the Customer Agreement with us (Barclays Bank PLC) apply to the use of the Barclays Pingit Wallet Account (the 'account'). These can be found at Barclays.co.uk/pingit. The following additional conditions also relate to the Barclays Pingit Wallet account and supplement and amend the general conditions.


1. Operating the account

1.1 The account is an e-money account which can be used to make or receive payments through the Barclays Pingit smartphone app. You can only operate your account through the app.

1.2 You can top up or fund your account up to any amount:

(a) By direct transfer (for example using Online or Telephone Banking) from any of your other UK bank accounts

(b) By standing order

(c) By paying in cash over the counter at a Barclays branch

(d) Using a debit card or any other means we advise you from time to time

1.3 You can only receive payments up to a maximum of £5,000 per day into your account from other Barclays Pingit users. If a payment is sent to you that will cause you to exceed this limit, we will return it to the sender.


2. Redeeming funds and making payments

2.1 You can redeem the funds in the account at any time by using the app to transfer funds to the UK bank account you used when opening your account. No fee will be charged for redeeming the funds. If you ask to redeem more than £2,500 at any one time, your request may be subject to additional security checks which will be carried out before the instruction can be processed.

2.2 You can also use the account to make payments using the Barclays Pingit service, as provided for in the terms for that service.

2.3 You cannot make payments in any other way.


3. Placing limits on your account

3.1 Depending on the information you provide when registering for the service, we may require you to complete registration at a Barclays branch or to provide us with further information before you can use the account. We may also sometimes place limits on the amounts you can send, receive or withdraw using the account. We will tell you these limits when you register and the steps you need to take for us to remove them.

3.2 If you do not take those steps within 12 months of opening the account or before you reach any of the above limits, we will suspend your use of the account.


4. Transaction information

You will be able to access through the app information about recent payments into and out of the account. If you ask us to, we will also provide details about transactions in writing.


5. Interest

No interest is payable on this account.


6. Closing the account

The account can be closed at any time in accordance with the general conditions. If you have not redeemed the funds in your Account within 6 years of it being closed, we will have no further obligation to repay the funds.
